Information on the data transfer to third-party countries that are not secure under data protection law and the transfer to US companies that are not DPF-certified
We use, among other technologies, tools from companies located in third-party countries that are not safe under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When you visit our software portal at bgu-teleservice.de, we collect and process the following data: Login data (user name and password), time, date and duration of user login/logout including failed login attempts, user interactions, e.g. setting commands and setpoints or acknowledging faults, configuration changes to process variables and system settings, activation and modification of recipes and their data records.
In the event of important changes, for example to the scope of the offer or technically necessary changes, we will use the contact details provided during registration to inform you in this way.
The data entered is processed for the purpose of implementing the user relationship established by the registration and, if necessary, for the initiation of further contracts (Art. 6 para. 1 lit. b GDPR).

If we are unable to make you a job offer, you reject a job offer or withdraw your application, we reserve the right to retain the data you have submitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). If it is evident that the data will be required after the expiry of the 6-month period (e.g. due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.
Data may also be stored for longer if you have given your consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations prevent deletion.
Inclusion in the applicant pool
If we do not make you a job offer, you may have the opportunity to be included in our applicant pool. If you are accepted, all documents and details from your application will be transferred to the applicant pool so that you can be contacted in the event of suitable vacancies.
Inclusion in the applicant pool is based exclusively on your express consent (Art. 6 para. 1 lit. a GDPR). Giving your consent is voluntary and is not related to the current application process. The data subject can withdraw their consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no legal grounds for retention.
The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.

We process your personal data that we receive from you or third parties in the context of business relationships. As a rule, this is contact data (name, address, telephone number and e-mail address) and – if necessary in the context of business transactions – bank and payment data (bank, account details, purpose of use, credit card information if applicable),
Information from publicly available sources, information databases and credit agencies (e.g. Internet, commercial register, credit agencies) as well as other data that you voluntarily provide to us in the course of processing a project or a contractual relationship or in the course of initiating a contract.
We process your personal data exclusively within the framework of the statutory provisions, in particular in compliance with the provisions of the General Data Protection Regulation (“GDPR”) and the EU Data Protection Adaptation and Implementation Act (“BDSG new”).
Processing is carried out on the basis of the legal bases described below and for the following purposes
- contract initiation, contract performance and termination of contractual relationships (Art. 6 para. 1 b GDPR), e.g. fulfillment of a contract (such as delivery or provision of a service and payment processing), general communication with business partners, e.g. answering inquiries about products and services, contract negotiations, etc.;
- on the basis of consent given (Art. 6 para. 1 a GDPR), e.g. sending newsletters or information letters, participation in marketing campaigns or surveys, etc.;
- due to legal requirements (Art. 6 para. 1 c GDPR), e.g. to fulfill commercial or tax law retention obligations, to fulfill reporting or information obligations to authorities, to fulfill auditing obligations, etc;
- on the basis of a legitimate interest (Art. 6 para. 1 f GDPR); e.g. measures for IT security or measures to ensure proper business operations, to safeguard domiciliary rights, to assert legal claims or defend against legal disputes, to ensure compliance requirements, for efficient customer management and customer communication, to avoid payment defaults, for direct advertising to maintain a customer relationship, etc.
Recipients or categories of recipients of personal data
We transfer your personal data to authorities/public bodies if required by overriding legal provisions.
We also use external service providers for various business transactions, e.g. IT service providers, transport service providers, payment service providers, auditing and consulting companies. Where necessary, contracts for order processing have been concluded with service providers within the meaning of Art. 28 GDPR in order to ensure the protection of your personal data.
The recipients described above may generally be located within the European Economic Area. Should a transfer to a third country be necessary at any time, we will ensure that this transfer only takes place in accordance with the statutory provisions (Chapter V GDPR).
Duration of storage
As a rule, personal data is deleted after the legally prescribed retention periods have expired. If the personal data is not affected by these retention obligations, it will be deleted when it is no longer required for the purposes described above. A different retention period may apply if you have consented to this when the data was collected.
